I was falsely arrested, a victim of police brutality and received bogus charges against me.
On the night of September 29th, 2006 (my birthday) my girlfriend and I went out to celebrate my 33rd birthday.
Initially it was just 3 of us but then 2 other couples joined us at Kokomo's bar in Lake Havasu City. My girlfriend, who admits to having a drinking problem, to no surprise got extremely drunk and knocked me off of my bar stool.
I was sitting at a table with our friends. She had been going to and from the bathroom due to the amount of liquid she had been drinking.
The Kokomo's security and my friends helped me up as my girlfriend ran to the front entrance of Kokomo's.
I sat back on my chair and my friend asked me, "what's up with that?"
I said I don't know.
I noticed my girlfriend running towards the front of Kokomo's and I decided to follow. When I caught her she was already at the front of Kokomo's.
Without asking me any questions, Kokomo's security escorted me around to the front of the London Bridge resort. I asked them where we were going and they just told me to shut up.
I wasn't concerned because I knew I had done nothing wrong.
When we got to the front, they sat me down on the curb and just told me to wait there.
A couple of minutes later the police pulled into the parking lot with their lights flashing.
As the police pulled into the parking lot, Kokomo's security then placed hand cuffs on me very tightly. I did not like this and I told them to take them off or at least loosen them.
When the police approached me one of them was extremely angry and loud. Screaming in my ear and accusing me of hitting my girlfriend.
I didn't like this and I began getting extremely upset too.
I told them to remove the cuffs because I didn't assault anyone.
They then asked me how she got a mark from her glasses on her face.
I told them I don't know.
They ended up interviewing her and somehow got her to press charges against me. Mind you the next day she said she blacked out and didn't remember even attacking me at the bar.
So the police decided they wanted to arrest me and the Kokomo's security removed their handcuffs and I rubbed my wrists to help the pain from the handcuffs go away.
The police, still angry and screaming and yelling at me placed me in their handcuffs.
I told them that I had witnesses and that I was the one that was attacked.
They said oh yea, you have witnesses? I said yes and the asked me for their names.
I told them their names and the police officers blew it off as if I hadn't said anything. Then they removed my vision glasses and started walking me towards the police car. An officer on each side of me.
At the time of the arrest I was sick so as we were walking up to the police car I began caughing and spitting out mucus.
Then the officer on my left screamed in my ear to spit again, spit one more time. I spit again and he yelled out, that is assault.
He then took control of me from the other police officer and slammed my face in the hood of the patrol car.
The blow to my face was with such tremendous force I thought all of my front teeth had fallen out of my mouth.
They didn't but it did cause my nose and mouth to bleed extensively. Enough to drip blood on my clothes.
Me being almost unconcious from the blow to my head, I remember someone wiping the blood from my face because remember I was already in handcuffs.
In the police car, I told them that I was innocent, I have never been in trouble before and that I was going to file complaints against them for police brutality. They were still furious and screeming for me to shut up.
I started telling them about myself and how I am a good citizen and all they did was try to belittle me and initimdate me everyway they could think of. From my job and income to the ability for me to have a girlfriend.
When we got to the police station they give you a card to fill out to tell about yourself and now more police officers had joined in on the intimidation of me.
Laughing and verbal abuse went on and on.
The next morning I found out that there was two felony 6 charges against me.
The first one was asault domestic violence and the second was assault on a police officer.
I posted my $5000 bail and was released.
The next morning I hung out with my friends that were at the bar with us and they couldn't believe that I got arrested. They knew that if anyone should have been arrested it should have been my girlfriend.
My girlfriend couldn't hang out because she was too hung over from the night before. I got the two police reports from the police station and they were just filled with lies and exagerations. They even put stuff that my girlfriend knows she didn't say.
I went to court when I was asked to and the original charges were dropped. We thought we had dodged a bullet and I decided not to file a police brutality complaint so that I could just go on with my life.
About a month later, I got a certified letter in the mail saying the DA has filed 3 new misdemeanor charges against me.
M1 Disturbing the peace domestic violence,
M1 resisting arrest (me rubbing my wrists due to the pain) and
M3 assault.
Needless to say I wish I did go through with the police brutality complaint.
So now I have hired a lawyer and I am awaiting trial.
They gave me a plea bargain but it is completely ridiculous.
They want me to have 3 years probation with no alchohol, anger management counselling, $1500 fine and 180 days in jail with 150 days suspended.
All of this because the police didn't take the time to figure out what actually happened. They made it very clear they had something personal against me and they assaulted me.
